O.M.T.P.A.  BYLAWS

MODIFIED TRACTOR DIVISION

ARTICLE 1
NAME AND OBJECT OF ASSOCIATION



SECTION 1 - NAME
This association shall be known as the Ohio Modified Truck and Tractor Pullers Association Inc.
herein after referred to as the O.M.T.P.A.



SECTION 2 - OBJECTS
To form an association to be governed by rule and regulations set forth by the group in order to govern
the O.M.T.P.A. rules and regulations.




SECTION 3 – CONTRACT DEFAULT
If a problem arises at or before a pull that involves contract terms the O.M.T.P.A. can decide not to pull
at this event if there is a majority vote from the members registered to pull.  This involves any subject
that does not meet the contract terms of the O.M.T.P.A. unless already agreed upon by the O.M.T.P.A.
and approved by its board members.






ARTICLE 2
MEMBERSHIP



SECTION 1 - QUALIFICATIONS
Any person, firm or corporation interested in the tractor and truck pulls that the O.M.T.P.A. is involved
in may become a member of this association.


SECTION 2 - POINTS MEMBERS
Any of the members of the O.M.T.P.A. meeting all guide lines set forth and competing for prize money,
awards or points shall be known as a point’s member.


SECTION 3 – NON O.M.T.P.A.  EVENTS
A puller can pull at a non – O.M.T.P.A. event, however if there is a O.M.T.P.A. pull scheduled for the
same time it is encouraged that the puller support the O.M.T.P.A. event.  If a puller chooses to pull at
the non-O.M.T.P.A. event instead of the O.M.T.P.A. event the tractor will lose 10 points from its points.






ARTICLE 3
FISCAL YEAR

SECTION 1 - FISCAL YEAR
The fiscal year for the O.M.T.P.A. shall begin on the first day of January of each year, and end on the
last day of December of that same year.




ARTICLE 4
DUES




SECTION 1 - ANNUAL DUES
The annual dues each fiscal year shall be for each type of member as follows:        
Point members $25.00 per year / per tractor.



SECTION 2 - PAYMENT OF DUES
Point’s members dues are payable by April 15th in each fiscal year.  All dues must be paid in full
before your first hook.



SECTION 3 - INSURANCE FEES
Insurance fees will be paid per tractor and must be paid in full before competing at an O.M.T.P.A.
Event.  The fee for insurance is per tractor and is as follows:
Points member $200.00
$25.00 membership dues

SECTION 4 - Associate. Members
A fee of $125.00 Per Hook at an event will be charged for associate to participate


SECTION 5 - DEFAULT AND TERMINATION OF MEMBERSHIP
When any member shall be in default in the payment of dues and insurance fees by April 15th of the
current fiscal year, the membership may thereupon, be terminated by 2/3 vote of the membership of
the officers, without notice of statement of the charges.






ARTICLE 5
MEETINGS


SECTION 1 - ANNUAL MEETING
There shall be an annual meeting at the end of the pulling season of each year for the election of
officers, and for receiving annual reports of officers, directors, and committees and the transaction of
other business.  Notice of the meeting, signed by the secretary, shall be mailed, except as herein or by
statute otherwise provided, to the last recorded address of each member at least ten (10) days and
not more than fifty (50) days before the time appointed for the meetings.  The notice of the meeting
shall set forth the place, date, time, and purpose of the meeting.

SECTION 2 – SPECIAL MEETINGS
Special meetings may be called by the Officers at their discretion. Upon the written request of one
third (1/3) of the membership, the Officers shall call a special meeting to consider a specific subject.  
Notice for any special meeting is to be given in the same manner as for the annual meeting.  No
business, other than that specified in the notice of the meeting shall be transacted at any special
meeting of the members of the Association.

SECTION 3 - WAIVER
Not withstanding the provisions of any of the forgoing sections, a meeting of the members of this
association may be held at anytime and at anyplace within or without the State of Ohio and any action
may be taken thereat.

SECTION 4 - QUORUM
The presence in person of the majority of the members of the association entitled to vote shall be
necessary to constitute a quorum for the transaction of business.

SECTION 5 - VOTING
Each voting member must be present to cast their vote.  There will be only one (1) vote per tractor.

ARTICLE 6
OFFICERS



SECTION 1 - NUMBERS
The property, affairs, activities, and concerns of O.M.T.P.A. shall be vested in the Officers.  The
Officers shall, upon election, immediately enter upon the performance of their duties and shall
continue in office until their successor’s shall be duly elected and qualify.



SECTION 2 - ELECTION OF OFFICERS

The Officers may:
A.  Hold meetings at such times and places as it feels proper.
B.  Admit members and suspend or expel them by ballot.
C.  Appoint committee’s on particular subjects from members of
the O.M.T.P.A.
D.  Audit bills and disburse the funds of the Association.
E.  Print and circulate documents and publish articles.
F.  Carry on correspondence and communicate with other
Associations interested in tractor pulls.
G.  Employ agents.
H.        Devise and carry into execution such other measures as it
Deem proper and expedient to promote the objects of O.M.T.P.A. and to best protect the interest and
welfare of the members.



SECTION 3 - MEETINGS OF THE OFFICERS
A regular meeting of the Officers shall be held without other notice than this By-Law immediately after
and at the same place as the annual meeting of members.  The Officers may provide, by resolution the
time and place, either within or without the State of Ohio, for the holding of additional regular meetings
without other notice within such resolution.


SECTION 4 - QUORUM
A majority of the Officers shall constitute a quorum for the transaction of business.

SECTION 5 - NOTICE
Notice of the meeting to the Officers, signed by the secretary, shall be mailed to the last recorded
address of each member at least ten (10) days before the time appointed for the meeting.  The
president may, when he deems necessary, or the secretary shall, at the request in writing of the
Officers, and only five (5) days notice shall be required for such special meetings.

SECTION 6 - ABSENCE
Should any member of the Officers absent himself/herself unreasonably from three (3) consecutive
meetings of the Officers without sending the communication to the president or secretary stating
his/her reason for doing so, and if his/her excuse should not be accepted by the members of the
Officers, his/her seat on the Officers may be declared vacant, and the president may forth with
proceed to fill the vacancy.


SECTION 7 - VACANCIES
Whenever any vacancy occurs in the Officers by death, resignation, or otherwise, it shall be filled
without undue delay by a majority vote by ballot of the remaining Officers at a special meeting which
shall be called for that purpose.  The election shall be held within sixty (60) days after the occurrence
of the vacancy.  The person so chosen shall hold office until the next annual meeting or until his/her
successor shall have been chosen at a special meeting of the members.


SECTION 8 - REMOVAL OF OFFICERS
Any one or more Officers may be removed either with or without case at anytime, by vote of two-thirds
(2/3) of the members present at any special meeting called for that purpose.



ARTICLE 7
OFFICERS


SECTION 1 - NUMBERS
The Officers of the association shall be a president, vice-president, and a secretary/treasurer.


SECTION 2 - METHOD OF ELECTION
The election of the Officers shall be held at each annual meeting.



SECTION 3 - DUTIES OF OFFICERS
The duties and powers of the officers of the Association shall be as follows:


PRESIDENT
The President shall preside at the meeting of the Association and of the Officers, and shall be a
member, with right to vote, on all committees except the nominating committee.  He shall also, at the
annual meeting of the Association and such other times as he deems proper, communicate to the
Association such matters and make such suggestions as may in his opinion tend to promote the
prosperity and welfare and increase the usefulness of the Association and shall perform such other
duties as are necessarily incident to the office of the President.



VICE-PRESIDENT
In case of the death or absence of the President, or of his inability from any cause to act, the vice-
president, shall perform the duties of this office.




SECRETARY
It shall be the duty of the Secretary to give notice of and attend all meetings of the Association and its
several divisions and all committees and keep a record of their doings:

To conduct all correspondence and to carry into execution

All orders, votes, and resolutions not otherwise committed.

To keep a list of the members of the association

To notify the officers and members of the Association of                         their election






TREASURER
The Treasurer shall keep an account of all monies received and expended for the use of the
Association, shall make disbursements only upon qualified expenditures approved by the Officers.  
He/she shall collect the fees, annual dues, and subscriptions and deposit all sums to an appropriate
bank, or banks, or trust company approved by the Officers of the Association and make report at the
annual meeting or when called upon by the President.  Funds may be drawn only upon the signature of
the Treasurer or his appointed alternate.  The funds, books, and vouchers in his/her hands shall at all
times be under the supervision of the Officers of the Association and subject to its inspection and
control.  At the expiration of his/her term of office, he/she shall deliver over to his/her successor all
books, monies and other property, or, in the absence of a Treasurer-elect, to the President.  The office
of Secretary and Treasurer may be held by the same person.





ARTICLE 8



AMENDMENTS
These by-laws may be amended, repealed, or altered in whole or in part by a majority vote at any duly
organized meeting of the Association.  The proposed change(s) shall be mailed to the last recorded
address of each member at least ten(10) days before the time of the meeting which is to consider the
change(s).




ALL MEETINGS WILL BE GOVERNED BY ROBERTS RULES OF ORDER.
